CES Plus+ is the public-facing brand used on this website. References in these Terms of Service to “CES Plus+,” “we,” “us,” or “our” include the business entity identified on the applicable estimate, proposal, contract, work order, or invoice.
These Terms of Service (“Terms”) govern your use of the CES Plus+ website and your requests for estimates, appointments, and property services.
By using our website, submitting a form, requesting an estimate, scheduling service, signing a proposal, or authorizing us to begin work, you agree to these Terms. If you do not agree, please do not use the website or request services through it.
CES Plus+ provides property-related services in Charlotte, North Carolina, and surrounding communities. Depending on availability, location, property conditions, equipment requirements, and the agreed scope of work, our services may include:
Junk and debris removal;
Estate cleanouts, liquidation assistance, and estate-sale services;
Vehicle removal;
Excavation and trenching;
Grading and land reshaping;
Site preparation and clearing;
Gutter cleaning; and
Related residential and commercial property services.
The services available for a particular property will be identified in the estimate, proposal, work order, invoice, or other written agreement provided for that project.
The information on this website is provided for general informational and promotional purposes. Service descriptions, photographs, examples, estimated timeframes, and other website content do not constitute a binding offer or guarantee.
Actual results, equipment requirements, project duration, availability, and pricing vary based on property conditions and the agreed scope of work.
If these Terms conflict with a signed proposal, estimate, work order, estate-sale agreement, or other project-specific agreement, the project-specific agreement will control for that project.
You must be at least 18 years old and legally capable of entering into a contract to request or authorize services.
By requesting work at a property, you represent that you are:
The property owner;
An authorized tenant, property manager, executor, administrator, agent, or representative; or
Otherwise legally authorized to approve the requested work and the removal, sale, movement, or disposal of affected property.
You are responsible for obtaining any necessary permission from owners, landlords, homeowners’ associations, lenders, estate representatives, occupants, or other interested parties.
CES Plus+ may request proof of ownership, authority, identification, title, registration, or other documentation before beginning or completing certain services.
Unless expressly stated otherwise, estimates are based on the information and property conditions reasonably available when the estimate is prepared.
An estimate may change if:
The information initially provided was incomplete or inaccurate;
The quantity, weight, composition, location, or accessibility of materials differs from what was represented;
Hidden, underground, hazardous, unusually heavy, or prohibited materials are discovered;
Additional labor, equipment, transportation, disposal, permits, or subcontractors are required;
Site conditions change before or during the work; or
The customer requests additional or different services.
CES Plus+ will seek authorization before performing material work outside the agreed scope whenever reasonably practical. Minor adjustments reasonably necessary to perform the approved work safely and properly may not require separate written authorization.
Website forms and telephone conversations do not guarantee scheduling or pricing. A project becomes binding only when CES Plus+ accepts it and the parties approve the applicable proposal, work order, or other service agreement.
Service dates and arrival windows are estimates unless expressly guaranteed in writing. Weather, traffic, equipment issues, disposal-facility availability, unsafe conditions, prior projects, and events beyond our reasonable control may affect scheduling.
The customer must provide safe and reasonable access to the work area, including access for personnel, trucks, trailers, and heavy equipment when applicable.
The customer is responsible for:
Providing accurate access instructions;
Securing pets and informing occupants of the scheduled work;
Moving vehicles or personal property that may obstruct the work;
Identifying gates, septic systems, irrigation systems, private utilities, invisible fencing, drainage systems, fragile surfaces, and other relevant conditions;
Providing any necessary keys, gate codes, or permissions; and
Ensuring the property is reasonably safe for the requested service.
Additional charges may apply if CES Plus+ cannot access the property, must wait for access, or must return because the site was not ready as agreed.
Before work begins, the customer must disclose any condition that could affect safety, pricing, equipment, disposal, or performance, including:
Hazardous, toxic, biohazardous, explosive, or regulated materials;
Fuel, chemicals, paint, asbestos, mold, medical waste, firearms, ammunition, or controlled substances;
Unstable structures or surfaces;
Underground utilities or private utility lines;
Septic tanks, wells, drainage systems, irrigation, or buried objects;
Property-line or access disputes;
Items that must remain at the property;
Items believed to contain money, jewelry, documents, collectibles, or other significant value; and
Any condition that could create a risk to workers, equipment, occupants, or neighboring property.
CES Plus+ may stop or decline work if conditions are unsafe, unlawful, materially different from those disclosed, or outside our capabilities.
The customer must clearly identify what should be removed and what should remain. Unless otherwise agreed, CES Plus+ may rely on instructions from the customer or the customer’s authorized onsite representative.
Once items are loaded and removed, they may be transported, recycled, transferred, sold, delivered, or disposed of as CES Plus+ determines appropriate, subject to the agreed service and applicable law.
The customer is responsible for removing or identifying valuables and protected items before work begins. CES Plus+ is not responsible for an item removed according to the customer’s instructions or because it was reasonably presented as material to be removed.
Certain materials may be refused or may require additional charges and special handling.
CES Plus+ may provide estate cleanouts, sorting, liquidation assistance, and estate-sale services when specifically included in the project agreement.
The customer represents that they have legal authority to direct the handling and sale of estate property. CES Plus+ may require documentation confirming that authority.
Estate-sale services may involve:
Organizing and preparing items for sale;
Researching or recommending prices;
Displaying merchandise;
Managing the estate sale;
Processing sale transactions; and
Addressing remaining items after the sale.
The responsibilities of CES Plus+, applicable fees or commissions, sale dates, pricing authority, payment procedures, and disposition of unsold property will be stated in a separate estate-sale agreement.
CES Plus+ does not provide legal, tax, fiduciary, financial, or certified appraisal services. Informal pricing assistance is not a certified appraisal or a guarantee that an item will sell for a particular amount.
CES Plus+ does not select charitable organizations, determine whether an item qualifies for donation, or independently coordinate donations on a customer’s behalf.
At the customer’s direction and for an additional fee, CES Plus+ may transport approved items to a specific recipient or drop-off location selected by the customer. The customer is responsible for confirming that the recipient will accept the items.
CES Plus+ does not guarantee acceptance, tax deductibility, valuation, or the issuance of a donation receipt.
The customer must have lawful authority to request removal of a vehicle. CES Plus+ may require proof of identity, ownership, title, registration, lien status, property ownership, or other authorization.
The customer must disclose known hazards, missing components, inaccessible locations, locked steering, flat or missing tires, fluid leaks, and other conditions that could affect removal.
CES Plus+ may decline to remove a vehicle when ownership or authority is disputed or unclear. Vehicle disposition and any transfer-of-title requirements will be governed by the applicable written agreement and law.
The customer is responsible for accurately identifying private utilities and other underground improvements that may not be located through a public utility-location service.
Unless expressly included in writing, the customer is responsible for obtaining surveys, engineering services, soil testing, environmental reviews, easements, association approvals, and permits required for the project.
Excavation and land work can reveal rock, unsuitable soil, groundwater, buried debris, undocumented utilities, roots, unstable ground, and other concealed conditions. These conditions may require changes in scope, price, equipment, or schedule.
Minor variations in elevation, compaction, drainage, settlement, appearance, and surface finish may occur because of soil conditions, weather, later construction activity, and natural site movement.
CES Plus+ does not guarantee engineering or drainage outcomes unless a specific written guarantee is included in the project agreement.
Gutter cleaning may include removing accessible debris, clearing accessible downspouts, checking water flow, and collecting service-related debris when included in the approved scope.
CES Plus+ does not guarantee that gutter cleaning will correct problems caused by damaged, improperly installed, undersized, detached, leaking, or deteriorated gutters, roofing, flashing, fascia, drainage systems, or foundations.
CES Plus+ may decline or postpone work because of unsafe roof conditions, excessive height, weather, electrical hazards, unstable ladders or access surfaces, animal activity, or other safety concerns.
Repairs are not included unless expressly stated in the applicable proposal.
Pricing may be based on labor, project scope, time, volume, weight, disposal costs, equipment, transportation, access, materials, subcontractors, or other project requirements.
Deposits or advance payments may be required. The applicable payment schedule will appear in the estimate, proposal, invoice, or project agreement.
Unless otherwise stated in writing, payment is due when the work is completed. The customer remains responsible for approved work even if a third party was expected to make payment.
Past-due balances may be subject to reasonable collection costs and any late charge disclosed in the applicable agreement and permitted by law.
The customer is responsible for applicable taxes, permit costs, disposal charges, and third-party fees identified in the project agreement.
Cancellation and rescheduling requirements may vary based on the service, equipment, personnel, disposal arrangements, subcontractors, and materials reserved for the project.
Any applicable deposit terms, cancellation fees, or rescheduling charges will be disclosed in the project-specific agreement.
Nothing in these Terms limits a cancellation right that cannot legally be waived. If a transaction qualifies for a statutory cancellation period, the customer retains the rights provided by applicable law.
A service will not automatically renew unless the customer expressly agrees to a recurring-service plan containing its price, frequency, renewal terms, and cancellation instructions.
Recurring gutter cleaning or other maintenance services may be changed or canceled as provided in the applicable plan. CES Plus+ will provide any renewal notices required by law.
The customer may request changes before or during a project. Requested changes may affect pricing, scheduling, equipment, and completion dates.
CES Plus+ may require approval of a written change order before performing additional work.
Authorization may be documented through a signature, electronic approval, email, text message, recorded confirmation, or payment, as permitted by law.
The customer or an authorized representative should inspect the work promptly after completion and notify CES Plus+ of any concern as soon as reasonably possible.
CES Plus+ must be given a reasonable opportunity to inspect and, when appropriate, address a reported service issue before the customer hires another provider or alters the completed work.
Normal wear, preexisting damage, concealed conditions, later work by others, weather events, soil movement, and conditions outside the agreed scope are not service defects.
CES Plus+ may photograph or record work areas for estimating, documentation, safety, quality control, insurance, dispute resolution, and internal business purposes.
CES Plus+ will obtain permission before using photographs that clearly identify a customer or reveal sensitive personal information for public advertising.
Property photographs that do not identify the customer may be used in portfolios or marketing where permitted by law, unless the customer asks us in writing not to use them publicly.
By submitting your contact information, you authorize CES Plus+ to contact you about your inquiry, estimate, appointment, or project by telephone, email, or text message.
With any consent required by law, CES Plus+ may also send promotional communications.
Consent to receive marketing communications is not a condition of purchasing services. Marketing emails may be stopped using the unsubscribe instructions provided. Promotional text messages may be stopped by replying STOP or contacting us.
Message and data rates may apply. Message frequency varies.
CES Plus+ is not responsible for communications that are delayed, filtered, or delivered to an outdated or incorrectly provided address or telephone number.
If you submit a review, testimonial, photograph, or other feedback to CES Plus+, you grant CES Plus+ permission to reproduce and display that content for legitimate business and promotional purposes, subject to applicable law.
CES Plus+ will not knowingly publish a false review or materially alter the meaning of customer feedback. Any material incentive connected with a testimonial will be disclosed when required.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
CES PLUS+ DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
PROJECT-SPECIFIC WARRANTIES, IF ANY, WILL BE STATED IN THE APPLICABLE WRITTEN AGREEMENT. CES PLUS+ DISCLAIMS IMPLIED WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.
Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.
TO THE FULLEST EXTENT PERMITTED BY LAW, CES PLUS+ WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE WEBSITE OR SERVICES, INCLUDING LOST PROFITS, LOST USE, OR LOSS OF DATA.
CES Plus+ will not be responsible for damage caused by:
Inaccurate or incomplete customer instructions;
Undisclosed hazards or concealed conditions;
Preexisting defects or deterioration;
Items removed or handled according to customer authorization;
Work performed by others;
Weather, natural events, or conditions outside the reasonable control of CES Plus+; or
A customer’s failure to satisfy these Terms or the project agreement.
To the fullest extent permitted by law, the aggregate liability of CES Plus+ relating to a particular project will not exceed the amount paid to CES Plus+ for the portion of the service giving rise to the claim.
These limitations do not apply where liability cannot legally be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold CES Plus+ and its owners, employees, contractors, and agents harmless from third-party claims, losses, or expenses arising from:
Your lack of authority to approve the work;
Your violation of these Terms or applicable law;
Inaccurate instructions or failure to disclose relevant property conditions;
An ownership, boundary, title, or access dispute; or
Materials, vehicles, or personal property that you directed CES Plus+ to remove, sell, transport, deliver, or dispose of.
This section does not require indemnification for liability caused solely by the conduct of CES Plus+ where such indemnification is prohibited by law.
CES Plus+ is not responsible for delays or inability to perform caused by severe weather, natural disasters, utility interruptions, government actions, labor or supply shortages, disposal-facility closures, equipment failure despite reasonable maintenance, unsafe conditions, or other events beyond our reasonable control.
We will make reasonable efforts to communicate delays and reschedule affected work.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
Before filing a legal claim, the parties agree to make a good-faith effort to resolve the issue directly. Written notice of a dispute should describe the issue and requested resolution.
Unless applicable law requires otherwise, legal proceedings relating to these Terms or CES Plus+ services must be brought in a court with jurisdiction in the North Carolina county where the business operating as CES Plus+ maintains its principal place of business.
Nothing in this section prevents either party from pursuing a valid claim in small-claims court or seeking emergency injunctive relief.
Information submitted through the website is handled according to the CES Plus+ Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
CES Plus+ may revise these Terms periodically. Updated Terms will be posted on this page with a new effective date.
Changes apply prospectively and do not alter a previously signed project agreement unless the parties expressly agree otherwise.
If any part of these Terms is found unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms, the CES Plus+ Privacy Policy, and any applicable estimate, proposal, work order, change order, estate-sale agreement, recurring-service plan, or invoice constitute the agreement between the parties regarding the applicable subject matter.
No oral statement changes a written project agreement unless both parties expressly approve the change.
